कोई बात अपराध नहीं है, जो किसी ऐसे व्यक्ति द्वारा की जाए, जो उसे करने के लिए विधि द्वारा आबद्ध है या जो तथ्य की भूल के कारण, न कि विधि की भूल के कारण, सद्भावपूर्वक विश्वास करता है कि वह उसे करने के लिए विधि द्वारा आबद्ध है ।
दृष्टांत
(क) विधि के समादेशों के अनुरूप अपने वरिष्ठ अधिकारी के आदेश से एक सैनिक क भीड़ पर गोली चलाता है। क ने कोई अपराध नहीं किया ।
(ख) न्यायालय का अधिकारी क, म को गिरफ्तार करने के लिए उस न्यायालय द्वारा आदिष्ट किए जाने पर और सम्यक् जांच करने के पश्चात्, यह विश्वास करके कि यही म है, य को गिरफ्तार कर लेता है। क ने कोई अपराध नहीं किया ।

Nothing is an offence which is done by a person who is, or who by reason of a mistake of fact and not by reason of a mistake of law in good faith believes himself to be, bound by law to do it.
Illustrations.
(a) A, a soldier, fires on a mob by the order of his superior officer, in conformity with the commands of the law. A has committed no offence.
(b) A, an officer of a Court, being ordered by that Court to arrest Y, and, after due enquiry, believing Z to be Y, arrests Z. A has committed no offence.
